Terms of Service

Welcome to MornLift. These Terms of Service (“Terms”) govern your use of the MornLift mobile application (“App”) operated by MornLift (“we,” “our,” or “us”).

By downloading, installing, or using MornLift, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

MornLift is a daily affirmations application that provides:

  • Daily personalized affirmations
  • The ability to save favorite affirmations
  • Tools to create custom affirmations
  • Streak tracking for daily engagement
  • Shareable affirmation images
  • Optional premium subscription features

2. Eligibility

You must be at least 13 years old to use MornLift. By using the App, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the App with the consent of your parent or legal guardian.

3. User Accounts

MornLift does not require account creation. All features are accessible without providing an email address, phone number, or creating a password.

4. Subscriptions and Payments

Free Features

MornLift offers free features including:

  • Access to all affirmation categories
  • Daily affirmations
  • Limited favorites (up to 10)
  • Limited custom affirmations (up to 3)
  • Basic reminder functionality

Premium Subscription

MornLift Premium offers additional features for a subscription fee:

  • Monthly Subscription: $2.99 USD per month
  • Yearly Subscription: $19.99 USD per year

Payment Terms

  • All payments are processed through Apple's App Store
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID Account Settings
  • No refunds will be provided for partial subscription periods
  • Prices are subject to change with notice

Free Trial

If offered, any free trial period will convert to a paid subscription unless cancelled before the trial ends.

5. User Content

Your Content

“User Content” refers to any content you create within the App, including custom affirmations.

You retain ownership of any User Content you create. By using the App, you grant us a limited license to store and display your User Content solely for the purpose of providing the App's functionality to you.

Content Guidelines

You agree not to create User Content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Promotes violence or discrimination
  • Infringes on intellectual property rights
  • Contains malicious code or spam

We reserve the right to remove any content that violates these guidelines, though we do not actively monitor User Content.

6. Intellectual Property

Our Content

All affirmations, designs, graphics, user interface, and other content provided by MornLift are owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content
  • Use our content for commercial purposes
  • Remove any copyright or proprietary notices

License to Use

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • The App will meet your specific requirements
  • Any errors will be corrected

Health Disclaimer

MornLift is intended for general wellness and personal development purposes only. The App is NOT:

  • A substitute for professional mental health treatment
  • Medical advice or therapy
  • A diagnostic tool for mental health conditions

If you are experiencing mental health issues, please consult a qualified healthcare professional. In case of emergency, contact emergency services immediately.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or goodwill
  • Any damages exceeding the amount you paid to us in the twelve (12) months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless MornLift and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Modifications to the App

We reserve the right to:

  • Modify or discontinue the App at any time
  • Change features, functionality, or pricing
  • Limit or restrict access to the App

We will make reasonable efforts to notify you of significant changes.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Conduct that we determine is harmful to other users or us

Upon termination, your right to use the App will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved through:

  1. Informal Resolution: First, contact us to attempt to resolve the dispute informally
  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration

You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MornLift regarding your use of the App.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of changes by:

  • Posting updated Terms in the App
  • Updating the “Last Updated” date

Your continued use of the App after changes constitutes acceptance of the modified Terms.
